Welcome to AppAcademia. These Terms of Service ("Terms") govern your access to and use of the AppAcademia platform, including our website, web application, mobile applications, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using AppAcademia, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a school, organization, or other entity, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you may not access or use the Service. For users under 18, a parent, guardian, or authorized school administrator must accept these Terms on their behalf.
2. Description of Service
AppAcademia is an AI-powered K-12 education and school management platform that provides:
- Personalized adaptive learning powered by artificial intelligence.
- An AI tutor available 24/7 for student support across multiple languages.
- Exam preparation tools with AI-generated practice questions and assessments.
- Teacher tools including lesson planning, assessment creation, and classroom management.
- Parent and guardian dashboards for monitoring student progress.
- School administration tools including branding, user management, and analytics.
- Gamification features including XP, badges, leaderboards, and streaks.
- Real-time communication between teachers, parents, and students.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
3. User Accounts & Roles
The Service supports the following user roles, each with specific permissions and responsibilities:
- Students: Access learning content, AI tutoring, assessments, exam preparation, gamification, and study plans. Students under 13 must have accounts created by a parent, guardian, or school administrator.
- Teachers: Create and manage lessons, assessments, and classrooms. Access AI-powered lesson planning tools and student analytics.
- Parents/Guardians: Monitor their child's progress, communicate with teachers, and manage child account settings.
- School Administrators: Manage school-wide settings, user accounts, branding, subscriptions, and access school-level analytics.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree to use the Service only for lawful educational purposes. You may not:
- Use the Service to harass, bully, or harm other users.
- Share inappropriate, offensive, or illegal content through any platform feature.
- Attempt to gain unauthorized access to other accounts, systems, or data.
- Use automated tools, bots, or scripts to access the Service without authorization.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the AI tutor or content generation features to produce harmful, misleading, or inappropriate content.
- Share your account credentials with others or create multiple accounts.
- Circumvent any access controls, usage limits, or security measures.
- Use the Service in any way that violates applicable local, national, or international laws.
5. Intellectual Property
The Service and its original content, features, and functionality are owned by AppAcademia and are protected by international copyright, trademark, and other intellectual property laws.
- Our Content: All platform code, design, logos, AI models, and pre-built educational content remain the property of AppAcademia.
- User Content: Teachers and administrators retain ownership of original content they create on the platform (lessons, assessments, etc.). By uploading content, you grant AppAcademia a non-exclusive license to use it within the Service.
- AI-Generated Content: Content generated by our AI tools (lesson plans, assessments, study plans) may be used freely by the user who generated it for educational purposes.
- Student Work: Student-submitted work and data remain the property of the student (or their parent/guardian for minors).
6. Subscriptions & Payments
AppAcademia offers the following tiers:
- Free Tier: Limited access to core features with usage caps on AI tutoring, assessments, and storage. No credit card required.
- Trial Period: Full access to premium features for a limited time. Trial duration and terms are displayed at signup.
- Paid Subscriptions: Monthly or annual plans with full feature access. Pricing details are available on our website.
All payments are processed securely through Stripe. By subscribing to a paid plan, you agree to the following:
- Subscriptions automatically renew unless cancelled before the renewal date.
- You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
- Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge for refund requests.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
7. Termination
We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to other users, our platform, or third parties. Specifically:
- We may issue warnings for minor violations before taking action.
- Serious violations (harassment, unauthorized access, illegal activity) may result in immediate termination.
- Upon termination, you may request an export of your data within 30 days.
- School administrators may be notified if a user within their institution's account is terminated.
You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- AppAcademia is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- AI-generated content is provided as educational support and should not be considered a substitute for professional educational judgment.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable international laws and the laws of the jurisdiction in which AppAcademia operates. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of competent jurisdiction.
10. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Post the updated Terms on our website with a new "Last updated" date.
- Notify registered users via email or in-platform notification at least 30 days before changes take effect.
- For school accounts, notify the school administrator who may communicate changes to their users.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
